Firm Files Suit in Alameda County Superior Court to End Release of Noxious and Toxic Air Pollution

Kaplan Kirsch & Rockwell is thrilled to partner with the University of California, Berkeley’s Environmental Law Clinic (“ELC”) and Communities for a Better Environment (“CBE”) in filing suit against AB&I Foundry and the Bay Area Air Quality Management District. On October 25, 2022, attorneys for the ELC, CBE, and the Firm filed suit in Alameda County Superior Court. Firm attorneys Matt Adams and Wil Mumby are assisting ELC and CBE in litigation to end AB&I’s release of noxious and toxic air pollution that has harmed the community of East Oakland, California for over 20 years. The suit also alleges that the local air district failed to follow legally required public participation procedures in issuing “underground” regulations that loosened requirements on polluters like AB&I and aims to ensure toxic air pollution is addressed more quickly and with full public participation in the future. The Firm is committed to advocating for a safer and more sustainable Bay Area.
