Highways

Kaplan Kirsch & Rockwell has developed and implemented effective strategies for the finance; delivery; and approval of, or opposition to, highway projects throughout the country.  We represent state and local governments in seeking Federal Highway Act, environmental, land use, and other permits for highway projects.  We have assisted state departments of transportation, local governments, and others on public–private partnerships in building, financing, designing, operating, and maintaining highway and multi-modal facilities.  Our attorneys have also worked with state and local governments on innovative tolled and non-tolled finance projects.

Representative Experience

  • Representing the Colorado Department of Transportation in the procurement of a P3 project for the Central 70 project.
  • Represent a California city in the development of highway access and improvements to international airport.
  • Represented private entities proposing innovative P3 concession to address capacity needs in a complex mountain corridor.
  • Represented a major Midwestern city in the permitting and environmental review of interstate highway projects for access to a major hub airport.
  • Represented a Colorado local government seeking to implement a preferred alternative to improvements to a critical freeway, including in litigation regarding project review requirements under the Colorado Areas and Activities of Statewide Interest statute.
  • Represented a Colorado local government seeking to stop or mitigate detrimental beltway proposal and implement preferred highway improvements.
  • Represented one of the largest entertainment firms in the world on issues under the National Environmental Policy Act, Department of Transportation Act Section 4(f), and National Historic Preservation Act for construction of a new highway interchange to serve a proposed theme park.
