Kaplan Kirsch & Rockwell represented Colorado Legacy Land, LLC, in its acquisition of Cotter Corporation’s Cañon City, Colorado Uranium Mill (also known as the Lincoln Park Superfund Site) and Schwartzwalder Mine located outside of Golden, Colorado. Colorado Legacy Land, jointly owned by Legacy Land Stewardship PBC and Alexco Environmental Group (US), Inc., was formed specifically for the acquisition and will assume Cotter’s obligations for final site closure and environmental cleanup of the properties. The Firm represented Colorado Legacy in the negotiation of the asset purchase agreement, real estate and regulatory due diligence, the real estate closing, and in the transfer to Colorado Legacy Land of the permits, licenses, and regulatory agreements and orders with the Environmental Protection Agency and the State of Colorado that enabled this complex transaction.
Along with focusing on closure and cleanup, Colorado Legacy Land will pursue eco-friendly reuse and redevelopment solutions for portions of the properties that can lead to open space/recreation, alternative energy, and residential and commercial uses. The Firm continues to represent Colorado Legacy in the environmental closure and cleanup and redevelopment matters associated with the two sites.
