On May 27, 2011, the FAA published a Notice of Proposed Rulemaking to amend 49 C.F.R. Part 23, the rules governing Airport Concession Disadvantaged Business Enterprises (ACDBEs).  The changes are intended to harmonize Part 23 with changes made in January 2011, to 49 C.F.R. Part 26, DOT’s rules governing Disadvantaged Business Enterprise (DBE) in federally-assisted projects.  The proposed changes to Part 23 would increase the personal net worth standard, increase airport obligations to monitor actual work performed by ACDBEs, and revise the accountability requirements for airports not meeting their overall goals for ACDBE participation.  In addition, DOT is seeking comment on whether other provisions of Part 23 should be changed to account for the recent amendments to Part 26.  The comment deadline is July 26, 2011.
