On April 9, 2012, the FAA granted in part the petition filed by the Clark County Department of Aviation (CCDOA) requesting a determination that the proposed incentive program for the Las Vegas McCarran International Airport be declared consistent with federal law and policy. In April 2011, CCDOA filed a petition concerning its proposal to discount airline landing fees in the event that the airline increases its landed weight, as compared to the same month of the previous year. The FAA determined that offering an incentive for increased landed weight would be permissible if certain conditions are met, including that upgauging not be the only means of qualifying for the incentive, that the airline not cancel existing service on the routes for which the airport sponsor is offering incentives, and that the airline not reduce service in other markets targeted.
