On May 17, 2012, the FAA sought approval from the U.S. Court of Appeals to hold a pending case on pilot fatigue standards in abeyance so the FAA can supplement the record and seek further public comment. The FAA issued a final rule on pilot fatigue in December 2011, in which it exempted cargo operations from new flight crew member duty and rest requirements. As previously reported in Airport Law News, Firm client, the Independent Pilots Association, petitioned the U.S. Court of Appeals for the District of Columbia Circuit to remand the proceeding to the FAA. In its May 17 motion, the FAA admitted to “errors” in the calculation of costs associated with the potential inclusion of all-cargo operations in the fatigue standards. FAA requested the court’s leave to hold the case in abeyance until the FAA prepares and opens for public comment a supplemental regulatory evaluation limited to the possible application of the rules to all-cargo operations.
