On July 1, 2020 the United States Court of Appeals dismissed a challenge to a new cargo facility at firm client BWI Marshall International Airport. The facility opened in October 2019. Howard County, Maryland, challenged FAA’s environmental review of the cargo project, largely based on concerns about unrelated changes in flight procedures previously adopted by the FAA. The Airport intervened in the case in support of the FAA. In an unpublish order, the Fourth Circuit dismissed the case finding that Howard County had filed the case too late under the applicable statute of limitations and that its delay was not justified. The Court did not address the merits of the case. A copy of the decision can be found here.
