My practice touches on virtually every aspect of environmental law. That means my clients can feel confident that the counsel they receive is informed by a comprehensive understanding of all relevant statutory and regulatory regimes that could be at play. This holistic approach, paired with a trained eye towards issue spotting, ensures that my clients fully understand the strengths and vulnerabilities that they face in any given scenario and allows them to make the most informed decisions affecting their businesses and missions.

That is why Tim has earned recent success guiding a client towards regulatory compliance and utilizing Colorado law to completely mitigate the client’s exposure to costly fees and penalties. Tim’s zealous advocacy also helped a coalition of local governments secure meaningful action from a state agency to evaluate new control measures to reduce methane emissions and ozone levels in Colorado communities.

Representative Experience

Regulatory Compliance, Permitting & Enforcement Defense

  • Represents private business and public universities before the Colorado Department of Public Health and Environment (CDPHE) on discharge permitting and compliance
  • Advises private business before CDPHE on site cleanup and remediation
  • Represented municipal government before CDPHE in administrative defense of notice of violation, cease and desist, and clean-up order due to sanitary sewer overflow event
  • Represented global manufacturer in DOJ grand jury investigation and responded to EPA and state agency issued information requests under the Clean Water Act (CWA), Toxic Substances Control Act (TSCA), Clean Air Act (CAA), and Resource Conservation and Recovery Act (RCRA)
  • Conducted internal investigations related to global manufacturer’s CWA and TSCA compliance, waste disposal practices, corporate governance, and Environment, Health, and Safety program
  • Assisted global manufacturer in administration of nationwide audit program focused on compliance with the CWA, TSCA, CAA, and RCRA
  • Advised offshore wind developer on National Environmental Policy Act compliance
  • Advised carbon capture non-profit organization on federal and state coastal law compliance

Air Quality & Climate Advocacy

  • Represented coalition of 40+ local governments in Colorado Air Quality Control Commission rulemaking hearings addressing industrial and manufacturing sector emissions; direct measurement and verification of oil and gas sector methane emissions; and Colorado’s ozone state implementation plan submittal to EPA
  • Advised Environmental Defense Fund on federal methane regulations for the oil and gas sector
  • Advised solar energy developer in California Air Resources Board rulemaking

Environmental & Public Lands Litigation

  • Represents coalition of archaeological and anthropological organizations in federal district court and appellate court litigation related to the President’s authority to restore the Bears Ears and Grand Staircase-Escalante National Monuments
  • Represents municipal government in CERCLA litigation related to legacy groundwater contamination at public airport

Environmental Due Diligence & Redevelopment

  • Advises commercial developers and non-profit on ASTM compliance of Phase I environmental site assessments for purposes of obtaining CERCLA liability protections
  • Advised municipal government on requirements for obtaining Brownfields grant funding for redevelopment of former manufacturing facility
  • Advised homeowners association on requirements for obtaining Brownfields grant funding for cleanup of contaminated tailings from legacy mining operations
