Kaplan Kirsch is advising NJ Transit on the Gateway Program, a $23 billion program of railroad infrastructure projects including the new Hudson Tunnel, rehabilitation of the existing tunnel between New Jersey and New York, and other projects between New York Penn Station and Newark Penn Station. The firm’s involvement includes advising on the governance structure of the multi-party Gateway Development Corporation, the bi-state Gateway Development Commission, and on the complex financial and funding plan from a multitude of sources including state, Amtrak, FRA, FTA and other sources, regulatory and grant compliance, railroad operating and maintenance obligations, construction and force account issues, and risk allocation including hazardous waste management and insurance, as well as interagency and program implementation issues.
