On August 17, 2012, the Federal Aviation Administration issued Program Guidance Letter 12-09 (“PGL”), which changes funding eligibility requirements for airport sound insulation programs. The PGL adds a new eligibility requirement that homes must have interior noise levels above DNL 45 decibels—in addition to the longstanding guidance regarding homes’ exterior noise levels—prior to being eligible for insulation, with a few limited exceptions. Most programs have not included an interior eligibility criterion.
