EMERGENCY RESPONSE COORDINATION & FUNDING

Coronavirus Preparedness and Resource Supplemental Appropriations Act (3/6/20)

  • $8.3 billion in emergency funding; $950mm specifically for grants/cooperative agreements with governments (including tribes)
  • Minimum $40mm to tribes, tribal healthcare organization, and tribal healthcare providers to be distributed by CDC to prevent, prepare for and response to COVID-19 (funded via grants)
  • $20mm to SBA for disaster loan programs
  • Centers for Disease Control and Prevention Funding Opportunities:
    • Noncompetative Grant: Supporting Tribal Public Health Capacity in Coronavirus Preparedness and Response (CDC-RFA-OT20-2004) – Link

Families First Coronavirus Response Act (3/19/20)

  • $64mm to support COVID-19 testing and response across Indian Country (75% federal cost share, tribes can request waiver)
    • HHS Secretary to cover 100% of costs of COVID-19 tests for American Indians and Alaska Natives
  • Provisions that may be of interest to some tribal employers (neither expressly applies to Indian tribes): Emergency Family & Medical Leave Expansion Act, and Emergency Paid Sick Leave Act

Coronavirus Aid, Relief, and Economic Security (“CARES”) Act (3/27/20)

  • $8 billion Coronavirus Relief Fund for Tribal Government
    • Target Distribution Date: April 24, 2020
    • Funding must be tied to COVID-19, cannot include previously-budgeted costs, and covers costs incurred from March 1 through December 30, 2020
  • $454 billion for loans and loan guarantees in support of the Federal Reserve’s lending facilities
    • Tribes expressly qualify as “states” for purposes of this appropriation
  • Tribes eligible for SBA Section 7(a) loan and other programs – Link
    • $10mm for Paycheck Protection Program – 100% loan guarantee of up to $10mm for payroll, rent, mortgage interest, and utilities
  • $1 billion for Indian Health Services
    • $450mm in direct distributions to tribes and tribal organizations through existing contracts/compacts
  • $453mm to Bureau of Indian Affairs
    • Estimated $380mm to be distributed as Aid to Tribal Government through existing contracts/compacts
  • $300mm to HUD for Indian Housing programs
    • $200mm distributed to tribes as 30.6% of 2020 IHBG formula allocation – Link

  • $69mm for Bureau of Indian Education

  • CA Governor and Public Health Officer and Director issued “shelter-in-place” order statewide on March 19, ordering all Californians to remain home except in connection with the provision of essential services:
    • Essential Services: gas stations; pharmacies; food markets (grocery stores, farmers markets, food banks, convenience stores), take-out and delivery restaurants; banks; laundromats; essential tribal, state and local government functions (law enforcement, government offices providing programs and services).
    • Prohibited: dine-in restaurants; bars and nightclubs; entertainment venues; gyms and fitness studios, public events and gathering, convention centers; personal service industry (hair, nails, spas).
