On December 19, 2018, the Environmental Defense Fund (EDF) filed a lawsuit to compel the U.S. Department of Transportation (DOT) to release records relating to the external correspondence and schedules of DOT officials who are believed to be playing a key role in the federal government’s plans to weaken greenhouse gas and fuel economy standards for light-duty vehicles and heavy-duty truck trailers. EDF requested these records under the Freedom of Information Act (FOIA), which requires federal agencies to make requested public records promptly available. DOT has yet to provide the requested records to EDF in violation of FOIA’s statutory deadlines. Our firm represents EDF in this case, which seeks to bring transparency to DOT’s efforts to weaken these standards despite their clear public health and environmental benefits.
