UPDATED – Rail Law Alert – STB Listening Session re CSXT Service Complaints

STB Listening Session – CSXT Service Complaints

The STB will hold a listening session at 9:30 am on September 12, 2017, to address complaints about the reliability of CSXT’s service. Although the STB is holding the session primarily in response to complaints from shippers, problems with fluidity and timely operations on CSXT’s network affect other operators with whom CSXT shares track or corridor, including passenger rail providers. We are aware of significantly degraded on-time passenger performance on a number of shared CSXT lines.

The STB describes the purpose of the meeting as an opportunity to hear firsthand from CSXT’s senior officials and affected shippers about CSXT’s rail service and efforts to improve service. The Board has directed CSXT to send executive-level officials to the meeting to address questions and to provide a timeline within which CSXT will restore service to normal levels.

Any person wishing to speak at the meeting must file a notice of intent to participate with the STB in Docket No. EP-742 no later than September 7, 2017. Those attending without planning to speak need not register in advance. The session will be held in the Board’s hearing room at 395 E Street SW, Washington, DC.

UPDATE: On September 7, the STB announced that the listening session about CSX Transportation, Inc. service issues, originally has been indefinitely postponed. Because CSXT is headquartered in Florida, which currently appears to be in the path of Hurricane Irma, the STB has postponed the session to permit CSXT executives and other interested parties to attend to the potential impacts of the storm.

The STB advises that it will reschedule as soon as practicable. We will advise you of the new date.


UPDATE: On September 20, the STB announced that the listening session about CSX Transportation, Inc. service issues will be held at 9:30 am on October 11, 2017.

Any person wishing to speak at the meeting must file a notice of intent to participate with the STB in Docket No. EP-742 no later than September 29, 2017. Persons who previously submitted notices of intent need not resubmit their notices in order to participate in the October 11, 2017 public listening session. Those attending without planning to speak need not register in advance. The session will be held in the Board’s hearing room at 395 E Street SW, Washington, DC.
