Infrastructure, Major Projects, Public-Private Partnerships, and Alternative Delivery

The Firm’s Major Project, P3, and Alternative Delivery practice regularly advises on pre-procurement, procurement, and post-procurement matters relating to public-private partnerships (P3s / PPPs), including availability payment and revenue risk based DBFOMs, as well as other alternative delivery methods such as design-build, design-build + operations and/or maintenance, progressive design-build, and pre-development agreements (PDAs).  Our experience includes road (and toll road), bridge and tunnel, autonomous vehicle, rail, transit, and airport projects, as well as social infrastructure, water, and other sectors. 

Our Firm is unique in that our Major Project, P3, and Alternative Delivery practice sits within a firm that focuses solely on infrastructure projects and related work.  As such, all our practice group attorneys work alongside other attorneys with directly related areas of expertise.  Our team is therefore situated within a mutually reinforcing ‘neural network’ of related disciplines, which is particularly critical on major project delivery transactions.  This in turn fosters a more holistic approach to project delivery.

We are also among the few U.S.  firms that predominantly serve the public sector nationwide on P3s and other forms of alternative delivery for major projects.  Current and recent clients include: the City and County of Denver, the City and County of Honolulu, the New York Metropolitan Transit Agency (MTA) Construction & Development, the City of Chicago, the Chicago Transit Authority, the Colorado Department of Transportation, California’s San Bernardino County Transportation Authority, the Jacksonville Transportation Authority, the Virginia Department of Transportation's Office of Public-Private Partnerships, New Jersey Transit, GoTriangle, Los Angeles World, other major airport authorities, and various Native American tribal governments, as well as private sector entities such as Propeller Airports and private equity funds.
